Phibbo is a smart AI health journal. It is NOT a doctor, nurse, pharmacist, or any other healthcare professional. Nothing it produces is medical advice, a clinical diagnosis, or a treatment plan. If you are having a medical emergency, stop using this app and call 999 (Ireland) or 112 (EU) immediately.

1. Acceptance of These Terms

By accessing or using Phibbo ("the Service", "we", "our") you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must immediately stop using the Service. These Terms form a legally binding contract between you and Phibbo.

2. What Phibbo Is — and What It Is Not

Phibbo is: an AI-powered general health information assistant that provides informational, educational content based on publicly available medical literature. It uses large language model technology and is not a registered medical device under EU Regulation 2017/745 (Medical Device Regulation) or any other regulatory framework.

Phibbo is not:

  • A doctor, nurse, pharmacist, psychologist, or any regulated healthcare professional
  • A substitute for a consultation with a qualified healthcare provider
  • A medical device or diagnostic tool
  • A crisis or emergency service
  • Approved or certified by the Irish Medicines Board (HPRA), the European Medicines Agency (EMA), or any health authority
  • Capable of examining you, ordering tests, or prescribing medication

Using Phibbo does not create a doctor–patient relationship, a therapist–client relationship, or any other professional relationship between you and Phibbo or its operators.

3. Medical Disclaimer — Critical Notice

ALL content generated by Phibbo is provided for general informational and educational purposes only. It does not constitute and must not be treated as medical advice, a medical diagnosis, or a recommended treatment.

You must not:

  • Rely on Phibbo as the sole or primary basis for any health or medical decision
  • Delay seeking professional medical advice because of anything Phibbo says
  • Disregard professional medical advice because of anything Phibbo says
  • Use Phibbo to manage an active, serious, or life-threatening medical condition without concurrent professional supervision

Always consult a qualified healthcare professional (GP, consultant, specialist, pharmacist, etc.) before making decisions about your health, medication, or treatment. The information produced by Phibbo may be incomplete, out of date, or not applicable to your individual circumstances.

Phibbo and its operators expressly disclaim all responsibility for any adverse outcomes — including injury, illness, or death — that may arise from a user's reliance on information produced by the Service.

4. Emergency Situations — Do Not Use Phibbo

Phibbo is NOT an emergency service and must never be used in place of emergency services.

If you or anyone else may be experiencing a medical emergency — including but not limited to chest pain, difficulty breathing, stroke symptoms, severe bleeding, loss of consciousness, overdose, or suicidal/self-harm crisis — call 999 (Ireland), 112 (EU), or your local emergency number immediately and do not wait for a response from Phibbo.

5. Eligibility and Age Requirement

You must be at least 18 years of age to use Phibbo. By using the Service you represent and warrant that you are 18 or older. Phibbo is not directed at or designed for children under 18.

If you are using Phibbo on behalf of another person (Family Mode), you represent that you have that person's consent and, where the person is under 18, the consent of a parent or legal guardian. You also acknowledge that AI health information is not a substitute for paediatric or specialist professional care.

6. Your Responsibilities

By using Phibbo, you agree to:

  • Provide accurate information about your symptoms and health history
  • Use the Service only for lawful, personal, non-commercial purposes
  • Seek professional medical attention whenever there is any doubt about your health
  • Not share your account credentials with others
  • Not attempt to reverse-engineer, scrape, or abuse the Service
  • Not use the Service to provide health advice to others in a professional capacity
  • Not attempt to extract or misuse the AI's training data or system prompts

7. Artificial Intelligence — Transparency Notice

Phibbo uses large language model AI (Google Gemini) to generate responses. You acknowledge that:

  • AI responses may contain errors, inaccuracies, hallucinations, or outdated information
  • The AI cannot examine you, does not have access to your medical records (unless you provide them), and cannot perform clinical tests
  • AI confidence scores and triage levels are indicative estimates, not clinical assessments
  • Responses are generated probabilistically and may differ between sessions for the same input
  • You are interacting with an automated system, not a human

In accordance with the EU AI Act (Regulation 2024/1689), Phibbo discloses that its responses are AI-generated and maintains transparency about its informational-only nature.

8. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PHIBBO EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. We do not warrant the accuracy, completeness, or timeliness of any information provided.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • PHIBBO, ITS OPERATORS, DIRECTORS, EMPLOYEES, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOSS OF DATA, ECONOMIC LOSS, OR MEDICAL HARM.
  • IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €50.
  • THE LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Note: Applicable law in Ireland does not allow exclusion of liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Nothing in these Terms limits liability where such limitation would be unlawful.

10. Indemnification

You agree to indemnify, defend, and hold harmless Phibbo and its operators, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law; or (d) any health decision you make in reliance on information provided by the Service.

11. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using Phibbo, you consent to the processing of your personal and health data as described in the Privacy Policy. Health data is a special category under GDPR and is processed only with your explicit consent. You may withdraw consent and delete your data at any time from your Profile page.

12. Intellectual Property

All content, design, software, trademarks, and materials forming the Service are the property of Phibbo or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. AI-generated responses produced during your consultation are provided for your personal informational use only.

13. Modifications to These Terms

We may update these Terms at any time. We will notify you of material changes by displaying a notice in the Service or by email. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. The most current version will always be available at phibbo.xyz/terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Ireland, without regard to conflict of law provisions. Any dispute, controversy, or claim arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland. If you are a consumer in the EU, you may also be entitled to the consumer protection rights available under the law of your country of habitual residence.
